What Is Best Execution in Crypto — and What Does MiCA Require?

Best execution is the obligation to take all sufficient steps to obtain the best possible result for a client's order, considering price, costs, speed, likelihood of execution, and settlement. It is a cornerstone of investor protection in traditional markets — and under the EU's Markets in Crypto-Assets Regulation (MiCA), it now applies squarely to crypto-asset service providers (CASPs).

With MiCA's transitional period ending, best execution has moved from best practice to enforceable obligation for firms serving EU clients.

What "best execution" actually means

Best execution does not mean simply getting the single best price on every trade. It means having a documented process that consistently seeks the best overall result across several factors:

  • Price — the execution price obtained for the client.
  • Costs — explicit fees plus implicit costs like spread and market impact.
  • Speed — how quickly the order is executed.
  • Likelihood of execution and settlement — whether the order can realistically be filled and settled.
  • Size and nature of the order — large or unusual orders may weight factors differently.

The relative importance of these factors depends on the client, the instrument, and the venues available. What regulators expect is a clear, followed, and evidenced policy.

Why best execution is hard in crypto

Crypto makes the standard genuinely difficult to meet without the right tooling:

  • No consolidated tape. There is no official record of the best price across venues, so "best price" must be constructed from aggregated data.
  • Fragmented liquidity. The best result often requires splitting an order across many venues simultaneously.
  • Variable fees. Maker/taker tiers and rebates change the net cost of each venue, so price comparisons must be fee-adjusted.
  • 24/7 volatility. Prices move continuously, raising the bar for timely, well-documented execution.

Meeting a best-execution obligation in this environment effectively requires consolidated market data, smart order routing, and execution measurement — the core of an institutional execution platform.

What MiCA requires — and the July 1, 2026 deadline

MiCA (Regulation (EU) 2023/1114) is the EU's comprehensive framework for crypto-assets. July 1, 2026 marks the end of the EU-wide MiCA transitional period; after that point, entities providing crypto-asset services in the EU without the required MiCA authorization may no longer rely on transitional arrangements. There are no further grace periods after that date.

Among the market-structure controls CASPs are expected to operationalize, best execution documentation sits alongside conflicts management, surveillance tooling, and transparent fee disclosures. In practical terms, an authorized CASP that executes client orders is expected to maintain an order-execution policy, take sufficient steps to achieve the best result for clients, and be able to demonstrate that it did so.

Enforcement carries real weight. National competent authorities can impose fines of up to 12.5% of a CASP's global annual turnover for serious violations, and operating without MiCA authorization in the EU after the deadline is simply illegal.
